Terms of Service · Plenty Signature

These Terms of Service ("Terms") govern your access to and use of Plenty Signature (the "Service"), operated by Audacious Pixel ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Plenty Signature lets teams design, distribute, and manage email signatures, including hosted assets, campaign banners, tracked links, and click analytics. We may add, change, or remove features over time.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account and for your team members' use of the Service. You must be at least 18 years old and authorized to bind your organization to these Terms.

3. Acceptable use

You are responsible for everything you and your team members upload, send, publish, or store through the Service, including logos, images, and photos ("Your Content"). You agree not to use the Service to:

Send spam or unsolicited messages, or impersonate, phish, or deceive recipients;
Upload material you do not own or have the necessary rights to use;
Harass, threaten, defame, or infringe the rights of others;
Attempt to breach, probe, or disrupt the Service or its security, or upload malware;
Resell or provide the Service to third parties except as permitted for your own team;
Violate any applicable law or any third party's rights.

You also agree not to upload, host, or distribute any content that:

Infringes any copyright, trademark, or other intellectual-property or privacy right;
Is unlawful or promotes illegal activity;
Is sexually explicit or pornographic, or contains nudity;
Is violent, graphic, gratuitously aggressive, or threatens or incites harm;
Is hateful, harassing, or discriminatory toward any person or group;
Misrepresents your identity or affiliation; or
Contains another person's private or personal information without their consent.

We may review, refuse, or remove any content, and suspend or terminate any account, that we reasonably believe violates these Terms — with or without notice.

4. Subscriptions and billing

Paid plans are billed in advance on a recurring basis. Pricing scales with your active team size as described on our pricing page. Payments are processed by our reseller and merchant of record, Paddle, whose terms also apply to the transaction. You authorize recurring charges until you cancel. Cancellation and refunds are governed by our Refund Policy.

5. Your content and ownership

You retain ownership of Your Content. You grant us a limited, worldwide, non-exclusive license to host, store, process, reproduce, and display Your Content solely to operate and provide the Service to you.

You represent and warrant that you own, or have obtained all rights, licenses, consents, and permissions necessary to use, Your Content and to grant us the license above — including any logos, trademarks, brand assets, images, and photographs, and the consent of any identifiable person shown in a photo. You are solely responsible for Your Content and for ensuring it complies with these Terms and all applicable laws. We do not pre-screen content and are not responsible for content uploaded by you or your team.

Indemnification. You agree to defend, indemnify, and hold harmless Audacious Pixel and its officers, employees, and agents from and against any third-party claims, demands, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to Your Content or your breach of these Terms.

6. Intellectual property

The Service, including its software, design, and branding, is owned by Audacious Pixel and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.

7. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or if required to protect the Service or comply with law. Upon termination, your right to use the Service ends and we may delete your data after a reasonable period.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that signatures will render identically in every email client.

9. Limitation of liability

To the maximum extent permitted by law, Audacious Pixel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim arising out of the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or within the Service. Continued use after changes take effect constitutes acceptance.
